These terms apply to perchplaytoys.lol and to every reservation and purchase made through it. "Perch Play", "we", "us" and "our" mean Neeraj Preenand, trading as PerchPlay (Perch Play by Team Urban Play), of B-004, Renaissance Exotica, Opp. Sobha Ultima, Jakkur Plantation Road, Yelahanka Hobli, Bengaluru, Karnataka 560064. "You" means the person using the site or buying from us.
By using this website, reserving a set or placing an order, you agree to these terms, and to our Privacy Policy, Refund and Cancellation Policy and Shipping and Delivery Policy, which form part of them. Nothing in these terms takes away your rights under the Consumer Protection Act, 2019 or any other law that protects you as a consumer.
1. Our products
Every Perch Play set is cut from wood and painted by hand. We describe and photograph each product as accurately as we can, but no two sets are exactly alike: small differences in wood grain, paint and finish are part of how they're made, not defects.
Colours on screen depend on your display. The 3D models and colourways on this site, including the Colour it yourself designer, show what the toy looks like; they are a guide, not an exact match for the finished paint.
Colourways marked "coming soon" are not yet for sale.
2. Prices
Prices are in Indian rupees (₹) and include all taxes. Any delivery charge is shown before you pay. We may change prices at any time, but a change never affects an order you've already paid for.
If a product is listed at a clearly wrong price because of an error, we will tell you before dispatching and let you choose to pay the correct price or cancel for a full refund.
3. Waitlist and reservations
Joining the waitlist, asking to be notified, or reserving a set is not an order. You pay nothing, and neither you nor we are obliged to complete a sale.
If you reserve a set, we will send you a payment link when our checkout opens, priced at the price shown at that time. Reserved sets are offered in the order reservations were made, while stock lasts. If you don't pay within the time given in the link, your reservation may lapse.
4. Orders and payment
Your order is a request to buy. It is accepted, and a contract formed, when we confirm it by email or message after your payment succeeds. We may decline an order, for example if a product is out of stock, we can't deliver to your address, or we suspect fraud. If we decline an order you've paid for, we refund you in full.
Payments are processed securely by Razorpay (and, where used, Shopify checkout). By paying, you also agree to their terms. We never see or store your full card or banking details.
You must be 18 or over to place an order, and the details you give us must be accurate.
5. Delivery, returns and refunds
Delivery is covered by our Shipping and Delivery Policy, and cancellations, returns and refunds by our Refund and Cancellation Policy. Responsibility for the goods passes to you when they are delivered.
6. Safe play
Perch Play is designed for children aged 1 to 7. Its magnets are fully embedded, and every piece is larger than 3 × 6 cm. To keep play safe:
- young children should play with it under adult supervision
- check the pieces from time to time; if any piece cracks, splinters or shows its magnet, stop using it and contact us
- read the safety labelling and care instructions that come with every set
- clean with a dry or slightly damp cloth; don't soak the pieces or put them in a dishwasher
7. Using this website
You may use this website to learn about Perch Play, design your own flock, reserve a set and buy from us. You must not misuse it: for example by trying to access parts of it or data you aren't meant to, overloading or disrupting it, submitting false or other people's details, or copying it in bulk.
We try to keep the site available and accurate, but we can't promise it will always be available, error-free or up to date.
8. The Colour it yourself designer
You may make as many designs as you like and save pictures of them for your own, non-commercial use, including sharing them on social media. The birds' shapes and the designer itself remain ours (see section 9). A design in the designer is not an order: we only sell the colourways listed as available on the Shop page.
9. Our designs and content
The Perch Play name and logo, the bird characters and their designs, our photographs, illustrations and packaging artwork, and the text and code of this website belong to us or to those who licensed them to us. The birds were drawn by designer Nandana Preenand. You may not copy, reproduce or sell them, or use them to make or market similar products, without our written permission.
10. Our responsibility to you
If a product we sell you is faulty or not as described, you have the rights described in our Refund and Cancellation Policy and under consumer law.
To the extent the law allows, we are not responsible for loss that we could not reasonably have foreseen, for delays or failures caused by events outside our reasonable control (such as natural disasters, strikes, or failures by couriers or payment networks), or for harm caused by using a product against its safety guidance. Our total responsibility for any order is limited to the amount you paid for it. None of this limits our responsibility for death or personal injury caused by our negligence, or for anything else the law does not allow us to limit.
11. Governing law and disputes
These terms are governed by the laws of India. If you have a complaint, please contact us first: most problems are resolved quickly. If we can't resolve a dispute, the courts at Bengaluru have jurisdiction, without affecting your right as a consumer to approach a consumer commission.
12. Changes to these terms
We may update these terms, for example when we change how we sell. The version on this page, with the date at the top, is the one that applies. An order is governed by the terms in force when you placed it.
